1. Acceptance of Terms

By accessing and using the services of Sunset Glow Lighting ("Company," "we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Sunset Glow Lighting provides professional holiday lighting installation, maintenance, and removal services for residential and commercial properties in Princeton, TX and surrounding areas. Our services include:

• Holiday lighting design and consultation
• Professional installation of lighting systems
• Maintenance and repair services during the holiday season
• End-of-season removal and storage services
• Custom lighting solutions and packages

3. Service Agreements

All services are provided under separate service agreements that will be provided to clients before work begins. These terms of service supplement, but do not replace, the specific terms outlined in individual service agreements.

4. Pricing and Payment

Pricing for our services is based on the specific requirements of each project and will be provided in written estimates. Payment terms are as follows:

• Payment is due upon completion of installation unless other arrangements are made in writing
• We accept cash, check, and major credit cards
• Multi-year contracts may be eligible for payment plans as outlined in the service agreement
• Late payment fees may apply to overdue accounts

5. Scheduling and Availability

Service scheduling is subject to availability and weather conditions. We reserve the right to reschedule services due to:

• Inclement weather conditions that pose safety risks
• Equipment or material delays beyond our control
• Client-requested changes or delays
• Emergency situations

6. Property Access and Safety

Clients agree to provide safe and clear access to all areas where services will be performed. This includes:

• Removing obstacles that may impede installation or maintenance
• Ensuring safe working conditions for our team
• Providing access to electrical outlets and power sources as needed
• Notifying us of any potential safety hazards on the property

7. Equipment and Materials

Unless otherwise specified in the service agreement:

• All lighting equipment and materials remain the property of Sunset Glow Lighting
• Clients are responsible for any damage to equipment caused by misuse or negligence
• We maintain insurance coverage for our equipment and operations
• Equipment will be removed at the end of the service period unless storage is arranged

8. Liability and Insurance

Sunset Glow Lighting maintains comprehensive general liability insurance. However, our liability is limited as follows:

• We are not responsible for damage to existing electrical systems unless caused by our negligence
• Clients are responsible for ensuring their electrical systems can safely support our lighting installations
• We are not liable for damage caused by severe weather, vandalism, or other acts beyond our control
• Our liability is limited to the cost of the services provided

9. Warranty and Maintenance

We provide the following warranty and maintenance services:

• All installations are warranted against defects in workmanship for the duration of the service period
• We provide maintenance visits as outlined in the service agreement
• Warranty does not cover damage caused by severe weather, vandalism, or client misuse
• Repair services are provided during normal business hours unless emergency service is arranged

10. Cancellation and Refund Policy

Cancellation and refund policies are as follows:

• Services may be cancelled with 48 hours notice without penalty
• A $75 cancellation fee applies only to cancellations made after November 15th
• Cancellations made on or before November 15th are free of charge
• We do not refund the cost of labor for services that have been completed
• Refunds for completed services are limited to situations where we are unable to fulfill our service obligations
• Partial refunds may be provided for services cancelled mid-season, less any costs already incurred
• Refunds for materials or equipment may be considered on a case-by-case basis, subject to the condition of returned items and our discretion

11. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Sunset Glow Lighting and is protected by copyright and other intellectual property laws. You may not use our content without our express written permission.

12. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of our services, to understand our practices.

13. Force Majeure

We shall not be liable for any failure or delay in performance under this agreement which is due to fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, labor strikes, or any other cause which is beyond our reasonable control.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these terms or our services shall be resolved in the courts of Collin County, Texas.

15. Changes to Terms

We reserve the right to modify these terms at any time. We will notify clients of any material changes by posting the new terms on our website and updating the "Last Updated" date. Your continued use of our services after any such changes constitutes your acceptance of the new terms.

16. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms will remain in full force and effect.
